Terms of Use

These Terms of Use (“Terms”) form a legally binding agreement between you (“you”) and YOUR SAFETY LTD (“we”, “us”), a limited company incorporated in England and Wales under company number 17139597, with its registered office at 128 City Road, London, EC1V 2NX, United Kingdom.

The Terms govern your access to and use of the Pingius mobile application (the “App”) and the Pingius VPN service (the “Service”). By installing or using the App, you agree to these Terms. If you do not agree, do not use the Service.

1. The App

The App is a VPN client distributed free of charge through the Apple App Store. The App connects your device to an encrypted VPN network operated by us when you provide a valid activation key issued to you by us or by an authorised service provider.

The App does not, by itself, provide network access. Activation keys are issued separately and are required for the Service to function. The App does not facilitate the sale or purchase of activation keys.

2. Eligibility

You may use the Service only if:

  1. You are at least 18 years old, or have permission from a parent or guardian if you are between 13 and 18.
  2. You are not located in or a resident of any country subject to a comprehensive UK or EU embargo, and you are not on any UK, EU, US or UN sanctions list.
  3. You comply with all applicable laws.

3. Activation keys

3.1 How keys are issued

Activation keys are issued at our discretion or by service providers authorised by us. The means by which you obtain a key are governed by the agreement between you and the issuing party, separately from these Terms.

3.2 Personal use

Activation keys are issued for personal, non-commercial use and are non-transferable. You must keep your key confidential. You are responsible for any use of the Service made with your key.

3.3 Lost or compromised keys

If you suspect your key has been disclosed or is being misused, contact developer@pingius.app so we can revoke and re-issue it.

4. Acceptable Use

You agree that you will NOT use the Service to:

We may investigate any suspected breach and, where we reasonably believe a breach has occurred, suspend or terminate your access to the Service without prior notice.

5. Service availability

We do not guarantee that the Service will be available at all times, in all locations, or that any specific server or feature will remain unchanged. We may modify, suspend or discontinue any aspect of the Service at any time.

6. Intellectual property

6.1 Our rights

The App, the Service, all software, designs, the “Pingius” name and logo, and related materials are owned by us or our licensors and are protected by intellectual-property laws.

6.2 Licence to use the App

We grant you a limited, personal, non-exclusive, non-transferable licence to install and use the App on iOS devices that you own or control, subject to your compliance with these Terms.

6.3 Restrictions

You must not reverse-engineer, decompile, disassemble, modify or create derivative works of the App, except where applicable law expressly allows it (including section 50B of the Copyright, Designs and Patents Act 1988).

7. Privacy

Our Privacy Policy explains how we collect, use and protect your personal data.

8. Apple App Store provisions

You acknowledge that these Terms are concluded between you and us only, and not with Apple Inc. (“Apple”). We — not Apple — are solely responsible for the App.

  1. Scope of licence. The licence in clause 6.2 is limited to Apple-branded products that you own or control, as permitted by the Apple Media Services Terms.
  2. Maintenance and support. We are solely responsible for any support for the App. Apple has no obligation to provide support.
  3. Warranty. Because the App is free of charge, no purchase price is payable to refund. We are responsible for any product warranty to the extent not effectively disclaimed; Apple has no warranty obligation with respect to the App.
  4. Product claims. We — not Apple — are responsible for addressing any claims by you or any third party relating to the App.
  5. Intellectual-property claims. We — not Apple — will be responsible for any third-party intellectual-property claim relating to the App.
  6. Legal compliance. You represent that (i) you are not located in a country subject to a UK, EU, US or UN embargo, and (ii) you are not on any UK, EU, US or UN list of prohibited or restricted parties.
  7. Developer name and address. Our name and address for legal notices are stated at the top of these Terms.
  8. Third-party beneficiary. You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9. Modifications

We may revise these Terms from time to time. Material changes will be notified through the App or by email. Continued use of the Service after changes take effect constitutes acceptance.

10. Termination

We may suspend or terminate your access to the Service immediately, without notice, if you breach these Terms or if we are required to do so by law.

You may stop using the Service at any time by uninstalling the App.

Clauses 6, 11, 12, 13 and 14 survive termination.

11. Disclaimers

Subject to clause 12.1 and your statutory rights as a consumer, the Service is provided “as is” and “as available”. We exclude, to the maximum extent permitted by law, all implied warranties including satisfactory quality, fitness for purpose, non-infringement and uninterrupted operation.

A VPN reduces certain privacy risks but does not provide complete anonymity. You remain responsible for your conduct online.

12. Limitation of liability

12.1 Liability we do not exclude

Nothing in these Terms limits liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be limited under English law.

12.2 Liability we do limit

Subject to clause 12.1, to the maximum extent permitted by law, we will not be liable for indirect, special, incidental, consequential or punitive damages, loss of profits, loss of revenue, loss of goodwill, loss of opportunity or loss of data. Our total aggregate liability under these Terms is limited to £100.

If you are a consumer, you may have additional statutory rights that are not affected by these Terms.

13. Governing law

These Terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that consumers may rely on mandatory consumer-protection laws of their country of residence.

14. General

14.1 Entire agreement

These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.

14.2 Severability

If any provision is held unenforceable, the remaining provisions continue in full force.

14.3 No waiver

Our failure to enforce any provision is not a waiver of our rights.

14.4 Assignment

You may not assign these Terms. We may assign to an affiliate or successor on notice to you.

14.5 Force majeure

We are not liable for failure caused by events beyond our reasonable control.

These Terms are in English. Translations are for convenience only; the English version prevails in case of conflict.
